Discriminating Against Tobacco Users: What Does the Law Say? Legal Webinar
Many workplace wellness programs include tobacco cessation components. In this webinar, attendees learned about state and federal laws that impact tobacco discrimination in wellness programs, such as HIPAA, the Affordable Care Act, ERISA and state anti-discrimination laws. Attendees also learned whether and when they can vary premiums for tobacco users, what kinds of incentives they can use to discourage tobacco use, and the implications of the methods they use to determine tobacco use status. They now understand the significance of whether an employer health plan is insured or self-insured for purposes of following state or federal laws.
