In this session, Barbara will cover the laws that govern tobacco cessation programs as well as explore a few recent lawsuits, such as Acosta v. Macy’s, Acosta v. Dorel Juvenile Group, and Dittman v. Quest Diagnostics, that occurred because of the employer group plan’s surcharges for tobacco use. She will also discuss the laws on handling employees who may lie about tobacco use to avoid a surcharge, as well as the importance of state laws that permit use of lawful products off duty.
